Email to Councillors Preston & Burnett regarding draft Hills Council 2010 LEP proposed zoning for our lands.  Discuss appropriateness of zoning our lands.  The draft 2010 LEP did not mention the "Residential R5 Large Lot Residential" zoning (this is provided for in the State Template 2010 LEP).  Our fundamental objection relates to the draft 2010 LEP and the absurdity of not identifying our land under a future category which is residential.   Instead, it has been classified as RU4 (Rural Small Holdings), a category
that is vague and uncertain and totally irrelevant for our land which has already been identified as overwhelmingly residential and not primary production/industry

Michael Edgar advised that under the present DOP/State Gvt attitude / policy, to have our lands rezoned under the draft 2010 LEP would not be possible.  Best tactic is to wait till 2015 LEP rewrite and, with the South Dural rezoning, would be better chance.  Consequently, it did not matter for the 2010 LEP that our lands were zoned RU4 (Rural Small Holdings) as there would not be permitted any rezoning.

Hills Council meeting, Cattai Tourist Precinct Planning was passed without debate, it is a proposal to reduce the minimum lot size at the 587 acre Riverside Oaks site to 150 square metres, to provide a total of 700 dwellings. Although they call it a tourist development, and repeat the word over and over again in the report, the predominant feature of the proposal is housing, not tourist facilities. The proposed hotel is now only 100 rooms, and they admit in the report that tourist facilities would not be viable as a stand-alone development.  It is first and foremost a housing development, regardless of what they choose to call it.

 

We have no objection to the owners of Riverside Oaks developing  their property in any way they wish, but have a very big problem with the way that the council has produced a report supporting it, while our  proposals for reducing the minimum lot sizes, throughout the current rural 1(c) area continues to have every obstacle and excuse for inaction thrown at it.  It shows a completely unacceptable set of double standards at work.

  Minutes of meeting:

 2156 Landowners Association.  Meeting with Bob Welsh Wednesday 20th April 2011 at Glenhaven.  The meeting commenced at 7:15 Pm

 Present:  Dave Parson  President,  Patrick Do Rozario Treasurer.  Connie Fimmano Secretary.

Members: Lebba Khater, Tony Fimmano, Sam and Maria Cipri, Roy and Joseph Fimmano.

Adviser: Bob Welsh

 Bob Welsh addressed the 2156 working group and presented his findings regarding the services which are required before making a submission tho the Hills Shire Council for the LEP.

 The boundary line of the proposed rezoning area on our original proposal was considered inadequate due to the Dural Dural Creek flow line and the catchment of the proposed lands had to be addressed  and changed so as the catchment was used to form the base of the proposed rezoning area.  This means that some of our members will need to be excluded (Note:  after the Meeting,  having regards to the Members register spreadsheet adresses, four members were determined to fall within this exclusion).  We agreed that we need to notify them in writing explaining that the decision to alter the boundaries has come about by the advice of expert  town planner Peter Lee.

 His enquiries with Bob Brown, Peter Lee (Planner) and Norman Mann who worked with Sydney water in Planning have come to the conclusion that we cannot use the existing tower at Dural and therefore a new Supplementary Tower of water is required. Bob found that the new water supply for Kellyville will not be available till 2025.  He feels that this may be somewhat incorrect and that the water will be available sooner.  There is  no problem with the electricity supply.  The Sewer served by Russell Treatment Works already proposed for Kellyville will be put in place by 2015.  Once that is in place we would need to build a pumping station and connect our lands to that system.

Bill Ray Frazer will advise as to the capacity of the Sewer System.

 Because our lands have not been considered in the Metropolitan Development Program (Department of Planning), Bob Welsh expressed that we will not have the support of Sydney Water and therefore all of these costs would have to be met by the Landowners.

 Given that we don’t have the money to address these expenses, the importance of a Funding Proposal for the Infrastructure needs to be put to our members.

 Bob Suggested that we need to address the Hills Council Councillors and present them with a short draft of our submission in seeking their support for our proposed inclusion in the rezoning of the land and also to be included in the Metropolitan Development Program.

 Dave asked Bob Welsh if he was prepared to use his letterhead when addressing the suggestion he presented to us in his representation to the submission we will make to the LEP on exhibition by the Hills Shire Councils.  He also asked him to make the changes to the map in question on the submission as well as draft the short letter to the Councillors. 

In addition, Patrick, as Treasurer, requested Bob to email his work-to-date fees so they we could arrange payment.  Bob Welsh agreed to all the requests and a meeting was proposed for  Wednesday the 4th May at 7pm at Glenhaven

Record of Meeting with Ray Williams MP

Friday 24 May 2011 at 4 pm at his Rouse Hill Office

Attendees:  Ray Williams, Dave Parsons, Lebba Khater, Stephen Lam and Patrick do Rozario

Commenced approx 4.10 pm 

Purpose: to discuss proposed biodiversity clause/map in the draft LEP 2010 and the 2156 Landowners Association Submission (which included North Glenhaven precinct planning proposal)

Biodiversity provision and mapping

Ray Williams mentioned that he had been working a lot with Micheal Edgar to get a proper outcome in rural subdivision and that there had not been any new 5 acre land releases since the 1970’s.  The draft LEP 2010 has changed that.[1] with, in particular, the rural cluster subdivision provisions.  Ray said that the biodiversity provision and mapping were really only to get the Dept of Planning more attracted to the proposal and would not affect our rural lands (proposed under the draft LEP 2010 to be zoned Rural RU4 Small Holdings).

 

He said that with the cluster subdivisions, a large proportion of the development would have to be preserved as community green space so that the other, more economically valuable portion of land, could be developed and marketed.  He cited the Cobran Road development in Kenthurst as a fine example of how rural lands could be developed with fine and attractive community and preservation of rural aspect. Housing prices there were at a premium.

 

North Glenhaven Precinct Planning Proposal

 

He said that all the Councillors and Hills (Development) Council (staff) were aware of the Glenhaven Road development and in favour of it.  However, the main problem was lack of money and provision of services.  He said that the trigger to the Glenhaven development would be the development of the South Dural lands.  Both the Hills Council and Hornsby Council wanted the South Dural development and he did not know what was holding it up.   He had contacted Sam Haddad.(Director General. Department of Planning) 2 months ago and was told that a decision would be made “in the near future”.  To date, there has not been any decision, so Ray will be sending out a reminder letter to Sam Haddad in the next 2 weeks.

 

Once the South Dural development goes ahead, Ray thought that this would force sewer works to be done along Glenhaven Road or the Glenhaven area so that that development could connect with the Rouse Hills treatment plant.  He said that Castle Hills treatment was full and that they were trucking waste from there to Rouse Hill which had lots of capacity.

 

Also, relevant for us, was the North Kellyville development.  Ray said that originally that area was not to be connected with the sewer until 2015 however, at present 50% has been done.  With the water, the projected date is 2020, however he believes that this will be accelerated too.

 

Metropolitan Development Program & Gateway provisions

 

Dave asked about what next for our Glenhaven lands what about the MDP and Gateway Provisions.  Ray said that the problem is that there was no money and this would have to be put forward by the Councillors via the Hills Council (Planning).  He thought that there would be no real benefit in lobbying the Councillors as they were all on-side and aware already.  The best way would be for the South Dural development to occur and then, as a matter of consequence, the Glenhaven development would need to occur and that would be taken up by Councillors/ Council directly.

Subsequent to the Ray Williams meeting

 

Dave, Lebba, Stephen and I had a meeting afterwards and decided on the following:

 

1.       Dave would call Bruce Lyon to get feedback as to how the South Dural development was going on as well as how Bruce thought the sewer lines to service our Glenhaven lands would run and be connected to (Rouse Hill?) (I would email Bruce’s contact details to him);

2.      Lebba was interested to know whether the North Kellyville development has any biodiversity mapping.  I said that I would find the maps and circulate them.

3.      We were still concerned about the biodiversity overlap mapping affected our Glenhaven properties and could not see the need (or fairness) for the mapping and potential disadvantage to us only for the RU Rural Landscape landowners who could now subdivide their lands under the community title provisions.  I agreed to draft a letter to Michael Edgar to test Ray William’s comment (without identifying him) that the biodiversity clause and mapping was meant to apply to the RU2 Rural Landscape landowners and would not have any affect for us (proposed Rural RU 4 Rural Small Holdings landowners).

Hi All,
 
Just got off the phone to Bruce Lyons.
A précis of our conversation:
• The sewerage service for South Dural will be via West Hornsby or Rouse
Hill.
• Sydney Water told him that they would like to look at Rouse Hill so that
they could expand the network to other residences ( presumably they were
looking at our land but I do not know).
• He has had meetings with the Minister ( in the last week or so) and is
expecting a decision from him within the next week on the South Dural
Proposal ( but it could be a little longer – 3 to 8 weeks).
• He is expecting the decision to be positive but warned that the South
Dural proposal had been going for 24 years.
• He said that we should sit tight and wait for the announcement on South
Dural then contact Sydney water and seek confirmation of their preferred
route for the sewer
• He believes Mike Edger is a “Straight shooter” but believes that the
BHSC is still strongly influenced by Green elements within the
bureaucracy.
• He suggests we pool forces if the South Dural subdivision is not
successful within the next few months.
Bruce also stated that he had read an article in the SMH last week
reporting that the State Government had said that the “State was open for
business” and that if anyone was experiencing difficult they should
contact them. He had the impression that the invitation included land
development proposals like ours. I have tried to find the article without
success.

Just had a very interesting conversation with Bruce Lyon’s.
 
1)         He seems confident that an announcement on South Dural will be
forthcoming within the next 6 weeks or so.
2)         He has raised the prospect of subdivision of our land at a very senior
level within the Dept of Planning.
3)         He acknowledges that it is possible to get the Council to pay for the
studies required to subdivide our land but very strongly recommended that
we go down the path of getting land owner to pay instead.
4)         A Council funding development will take twice as long and we would lose
total control of the process.
5)         If he was doing it again for South Dural he would use the Gateway
process. He suggested that it provides a faster more certain path for
subdivision.
6)         South Dural had 70 individual land owners ( which was about 80% of all
owners).
7)         We need to sell the landowners on the fact that the value of the land
will be substantially higher if it is subdivided. ( he sold them the
concept that the land was worth  $300K/ acre as is and say $600k/acre
subdivided). The investment of $10k for study was chicken feed when you
consider the potential increase in land valves.
8)         We should get a price for a master plan off Michael Brown and present
it at the AGM. He is also going to see if he can get someone else.
9)         He does not think that our potential for subdivision will be effected
even if the South Dural sewerage link is via Hornsby instead of Rouse
Hill.

1. Planning system review

As mentioned in my earler email, a
website has been established for the planning system review, as the first step in a robust community and stakeholder engagement process. The website outlines the consultation already underway and further consultation planned for the review.

[Should we used this apparent willingness for community consulation/ stakeholder engagement to further our cause? Normally, I am doubtful about bureaucrats and politicians visions, but as they are aiming to re-write the Enviro Planning Act, this may mean that they are serious????]

2. Local planning panel launched


A panel will be established to increase local government involvement in, and improve the flexibility of, the standard instrument local environmental plan (LEP).

The Minister has announced that, in addition to an independent chair, the panel will consist of two local government representatives and two from the Department.

Once appointments are made, the panel will initially contact councils to seek feedback about their experience regarding the implementation of standard instrument LEPs. Also, attached letter from the minister on this.


[Hopefully there will be some feedback from the Hills Council about what happened at last Tuesday's meeting and then problems Council has with the Biodiversity clause and sec 117(2) Directions on Rural Lands application to prohibit rural rezoning or smaller lot sizes]

Michael introduced himself and gave a brief summary of the developments he had been associated with, putting forward several development plans including that of South Dural.  He confirmed that Bruce Lyons believes that South Dural would be announced in the next 6 weeks and that the sewer lines would go through Rouse Hill and this would help getting those services to rural Glenhaven.

 

I forward some discussion points (including background - see Attachment A) to him and Michael emailed a quote from Steven McMahon - Inspire Urban Planning (see Attachment B) for a Masterplan for rural Glenhaven.  We noted that the quote was for $5,000 ex GST and did not include several key items eg required studies and hourly representation.

We noted that the letter mentioned that the Minister for Planning encouraged community consultation and particularly noted the following:

 

  In terms of “strategic justification”, my observations of recent comments from the Minister for Planning suggest that there is significant Strategic Justification if sites have urban capability. The Minister has stated on a number of occasions recently (including the Alan Jones Show and in fact repeated it today at an Urban Taskforce lunch I attended), that the Government is vitally interested in releasing land that can assist the housing shortage on the fringe of Sydney provided it is not constrained by lack of infrastructure.

 

He has publicly invited submissions from landowners and contact should be made with the Director General of the Department of Planning. Clearly the door is open to the Glenhaven land owners for such requests.

 

 

We ask if we could get, as realistic as possible, a quote that includes necessary studies  [flora/fauna; bushfire; services (water/sewer/electricity etc) and traffic impact] so that we could put the cost to our members to be accepted and have the necessary funding in place. 

 

Michael noted there we had some water/sewer reports from Brown Consulting that Bob Welsh commissioned and asked if he could get a copy to assess whether they are sufficient.  I said that I would get in contact with either Bob for Brown Consulting (direct, to which Michael gave me Peter Lee’s phone number 8808 5000 as the most suitable contact there).

 

He said that the gateway process was the best avenue and confirmed that having the submission includes required studies done at our expense was the quickest method as well as being able to retained control on the studies (which we could not do if we asked Council to do the studies).

 

Michael showed us the “Guide to Planning Proposal” from the DOP website and said that it was necessary to have as many landowners on-side as possible.  He confirmed that South Dural has 80% of the landowners on side.

We recognised that the large residences (eg Gilmore Close) might not want subdivision and that it may not be worthwhile for them or in their interests.  Micheal said that those large lot holdings (and neighbouring ones) could be preserved in the lots size planning maps.  It was important for them and others not to be vocally against subdivision.  It was recognised that there would be people against it and others for it, but not willing to pay anything.  We had to live with the “fence-sitters’ and those for subdivision yet not willing to contribute.

We needed to confirm our boundaries and get as many landowners on side as possible.  We needed to consult with the Hills Council, understanding their requirements as to degree of studies, as well as lodge and approach the Dept of Planning directly.

Michael said that these rezoning matters did not happen quickly and that it took patience, persistency and dealing with the right people.  We noted the impact of retirement villages in our rural area and that they did not pay section 97 contributions.

 

The meeting concluded with me undertaking to get the Brown Consulting services reports to Michael so that he could better estimate the quote for the Masterplan.

 

Subsequent meeting

When Michael left, we discussed whether Connie could put together a statement estimating the impact on property values for rural lands and then after subdivision approval.  I noted that North Kellyville property generally went from around $1.5M for 5 acres to $3M once rezoned, doubling its value.  Connie said that she would put something together to table at the meeting to encourage to get on-board with subdivision and contribute to the studies and costs.

A.     Background:

 

1.      Aware of Michael’s association with South Dural proposed development.

2.      Dave Parsons spoke to Bruce Lyons 1 ½ weeks ago and Bruce:

·         seemed confident that an announcement will be made within next 6 weeks;

·        Raised the prospect of subdivision of Glenhaven land at a “very senior level’ within the DOP;

·        Acknowledged that possible for Council to pay for studies required for subdivision but strongly recommended do own studies at our expenses as:

                                                   i.      Council will take twice as long; and

                                                 ii.      We would loose control of the process

·        He would use the “gateway” process if he had to do it again as it provides a faster more certain path for subdivision.

·        South Dural had 70 individual landowners (about 80% of all) and got them on-side with prospect of doubling of land value for a mere $10k contribution

·        Did not think our potential for subdivision will be effected even if South Dural sewerage links through Hornsby instead of Rouse Hill

3.      Dave Parsons spoke to Bruce Lyons on 29 June 2011 and Bruce:

·        Said that the South Dural sewer would be via West Hornsby or Rouse Hill

·        Sydney Water told him that they would look at Rouse Hill so that they could expand the network to other residences

·        We should wait until the announcement on South Dural then contact Sydney water seeking confirmation of their preferred sewer route

4.      Meeting with Ray Williams on 24 June 2011 (2 months ago) who said:

·        He spoke to Sam Haddad who said that a decision on South Dural will be made “in the near future

·        If he receives nothing from the DOP he will write to them in 2 weeks time for an update

·        That Hills Council and Planning staff were for Glenhaven subdivision but lack of services and money was the problem

·        Castle Hills sewer treatment was full and they are trucking waste to Rouse Hill which had lots of capacity.

5.      We have had meeting with Mayors, some Clrs and Michael Edgar who confirm that services are the issue and that they believed that if South Dural got OK for development then that would be the catalyst for our development – sewer from Rouse Hill would go up Glenhaven Road.

6.      Patrick spoke to Michael Edgar on 23 August 2011 and Dave/Patrick spoke to Clr Robyn Preston on 24 August 2011 with:

·         Michael suggesting that way to go was for us to approach Clrs to put forward a motion along the lines of “that studies be undertaken in rural Glenhaven (need to specify exact boundaries) to investigate the potential  for subdivision”.  Once Clrs approved then it would be on the Council bugets and then receive funding.

·        Raised this matter with Clr Preston who said that she would be happy to discuss this with Clrs for us.

7.      Lodged “North Glenhaven Precinct Planning Proposal” with submission on draft LEP 2010.  Reply is that the Planning Proposal is inconsistent with planning guidelines and the direction for strategic land use for North Ward for the foreseeable future.

Further to our discussions, I welcome the opportunity of assisting you in this project.

Background

I understand that for some time the landowners have been pursuing the rezoning of their properties at Glenhaven Road. This included a recent submission (Planning Proposal) in May 2011 on the Hills Shire Council Draft LEP 2010.

Having reviewed Council’s report on submissions 23 August 2011, I note that it considers that “considerable strategic justification is required to rezone rural land to residential or to increase the permissible density of rural land. This justification did not emerge from rural strategy work undertaken across 2000 to 2005 which found that the majority of the rural land was unsuitable for subdivision due to environmental constraints and infrastructure limitations.” (p.207).

Clearly, therefore, the key to unlocking the rezoning is: (1) the ability to demonstrate “considerable strategic justification” and the suitability of subdivision in light of (2) “environmental constraints” and (3) “infrastructure limitations.”

In terms of “strategic justification”, my observations of recent comments from the Minister for Planning suggest that there is significant Strategic Justification if sites have urban capability. The Minister has stated on a number of occasions recently (including the Alan Jones Show and in fact repeated it today at an Urban Taskforce lunch I attended), that the Government is vitally interested in releasing land that can assist the housing shortage on the fringe of Sydney provided it is not constrained by lack of infrastructure.

He has publicly invited submissions from landowners and contact should be made with the Director General of the Department of Planning. Clearly the door is open to the Glenhaven land owners for such requests.

The challenge for the Glenhaven landowners, therefore, is to demonstrate that urban development of their land can be achieved with minimal environmental impact (and maximum environmental protection) and that infrastructure can be cost effectively delivered to the site. I note from the Planning Proposal report that it states that Brown Consulting believes that this can be achieved. If it can be genuinely shown that infrastructure (sewer and water) can service the site, then much of the grounds for Institutional (Gov. Agency and Council) concern with any rezoning proposal should be addressed.

An Indicative master plan must demonstrate the principles how environmental protection can be achieved with urban development of the precinct. This would form the focus of my scope of work.

Scope of Work

In response I propose the following scope of work:

1. One Site Visit & Site Analysis (comprising site and surrounding areas) and preparation of site analysis plan;

2. One Workshop with Landowners. The workshop would agree master planning parameters such as lot sizes, dwelling types (including potential for “higher density” (i.e. integrated small lot, townhouse / senior’s living etc. sites), distribution/location of major open space, roads and access and indicative reservation of creek corridors and vegetated areas.

 

I would prepare an agenda and base maps. The parameters that would be agreed would be for indicative concept master planning purposes only (i.e. not a final development master plan) as they would not be supported by detailed traffic, flora and fauna etc. studies. They would also affect individual properties in different ways, which would require subsequent detailed investigation as the rezoning proceeded. At this time the parameters would merely illustrate the principles of urban development to demonstrate that environmental protection objectives as well as Government’s strategic justification” could be achieved.

3. Prepare Indicative Concept Plan and report. The Master Planning Parameters agreed above would be translated into an indicative concept plan that illustrates the potential for development, as well as the potential for environmental protection. The plan would be of presentation quality that could be printed out at large scale for presentation to Government. The concept plan would present similar detail to that which I prepared for South Dural (see attached image). It would not include a detailed subdivision plan, nor or any details on individual property yields/ lots etc. One set of minor amendments would be made to the plan after submission to the landowners for review.

 

The report would be a brief A3 landscape size colour document. It would include the site analysis, the Indicative Concept Plan and indicative Net Developable Areas (to establish potential yield (maximum 6 pages). Again it would be to presentation standard and support the actions of the Association in meetings with Government, letters etc.

At this time I do not envisage the need to meet with Council and do not suggest involvement in any further meetings in order to minimise costs to the clients.

Information Required

Services Analysis. While, not required for master planning, I note that it will be required to be addressed in the planning proposal and the ability to review the Browns’ report would be helpful;

Base castradal mapping including contours.

 

Professional Fees

Professional fees are based on the scope of work described above, and an estimation of hours and charge out rate presented in the following table.

• Does not include any other associated disbursements / outlays (provision of mapping, aerial photography, plotting and any additional travel (mileage/tolls/parking etc ) that may be required to deliver the service (that will be charged at cost); and

• Allows only for involvement and tasks noted above. Any additional work outside of these tasks (e.g. to attend to additional presentations or meetings etc) would be charged on a time basis plus any reimbursable costs (e.g. travel) or as negotiated. Hourly rates do not include any costs for travel or disbursements should they be required.

 

Current hourly rates are set out in the enclosed agreement for the provision of consultancy services, which I ask to be completed and returned in the event that approval is given to proceed.

We have received a somewhat disturbing email from Councilor Barbra Burton
who states that “Council officers [have] briefed Council on [our
Association’s] issues and have found them inconsistent with planning
guidelines and the direction for strategic land use planning for North
Ward for the foreseeable future”.
 
As an Association our members have spent thousands of hours responding to
Government invitations for public submissions as they relate to our
members collective objective to rezone our land. In the case of the 2010
LEP we also spent a substantial amount of our limited funds to engage
consultants.   Councillor Burton’s statement reinforces a very strong
feeling within our Association that the Council were never going to give
our submission proper consideration and our efforts were nothing more than
a waste of our time.
 
It is also a fact that Glenhaven is in dire need of major infrastructure
upgrades and urgent attention is needed to a number of other issues.
Rezoning of our land would provide badly needed funding towards these.
Specifically we refer to:
a)         Upgrades to Glenhaven Road,
b)         Traffic management facilities at the intersection of Glenhaven and
        Old Northern Roads,
c)         Expansion of playing fields at Holland Park,
d)         Bushfire risks associated with poorly managed bushland along Dooral
        Dooral and Cattai Creeks; and
e)         Potential contamination of our water ways from on site sewerage
        plant effluent.
 
There are also a number of other important issues which effect Glenhaven
Residents and for which rezoning our properties would address. These
include:
 
a)         The proliferation of retirement villages (please refer to
        explanatory note below) which is denying Glenhaven urgently needed
        Section 94 funding and is delivering poor rezoning outcomes for
        Glenhaven Residents,
b)         The non viability of small businesses, setup to service the
        Residents of Glenhaven (supermarkets, pharmacist, restaurants etc);
        and
c)         The positive potential the rezoning of our land would have on the
        South Dural development – which will bring a new hospital to our
        door step.
 
As such it is very difficult to see how the rezoning of our land is
“inconsistent with planning guidelines and the direction for strategic
land use planning for North Ward for the foreseeable future”.
 
We will be holding a public meeting with our members on the 14th
September. At the meeting we will be recommending our members contribute
funds to finance the preparation of a master plan for submission to the
Department of Planning under the new State government “Gateway”  process.
For this to be successful we need the support of the majority of
Councillors.
 
Before our members commit more time and their limited funds we would like
to obtain in principle support from the majority of Councillors. Would it
be possible for you to submit a request to the other Councillors on our
behalf  to determine if they would provide in principal support for our
Gateway submission?
 
Your ongoing support for our Association is gratefully appreciated, and we
look forward to your participation at our General Meeting on Wednesday
14th September next.

It is illogical and unfair to the Residents of Glenhaven that developers
of these retirement villages do not pay any section 94 levies for
provision of infrastructure, services and amenities in the immediate area.
 For example, the Living Choice development of some 97 retirement units on
13.25 hectares along Glenhaven / Holland Road, Glenhaven, has the
potential to add another 200 residents to the area.  Prior to development,
the 13.25 hectares would have represented 6 x 2.2 hectares lots with, say,
4 people living in each lot.  This totals only 24 people which is a minute
amount of people when compared to the 200 or so new people under the
present retirement village
development.  Yet, these people will not contribute to the local
infrastructure etc, leaving the burden onto the remaining non-urban
residents who are restricted from developing their lands under the absurd
2.2 hectare minimum lot size imposition

The meeting commenced at 7:05pm chaired by Dave Parson

Dave welcomed all present and while this took place Councillor Justin Taunton Vice Mayor for the Hills Shire Council joined the group apologising for his late arrival due to traffic.

Dave welcomed him and thanked him for coming. Dave also addressed the apologies of Mayor Mike Thomas, Ray William and Councillor Robyn Preston who could not be present due to previous engagements.

Dave confirmed the working group’s activities on the overhead as a power point presentation outlining the amount of work that has taken place over the last years since the formation of the Association. He then passed on the microphone to Patrick to address the General business of the Association.

Patrick outlined the Action taken by the Association pertaining to the work prepared and presented to the Hills Shire Council pending the exhibition of the LEP. This was done in the form of a submission by the Association. This Submission was prepared by Bob Welsh (Advisor) and Michael Brown(Planner) since they have the expertise in this department. The hourly rate for consultation and preparation of the document being $230.00 per hour. The costing of which had to be accommodated by a special levy paid by members of the working group as a loan to the Association because the funds available were not sufficient to cover these costs. Patrick stressed the importance of having the members financial support for the Association if we are to proceed to make the necessary representation that being a costly outlay. He gave Michael Browns’ assessment of the Preliminary Costing to preparer a submission of a Master Plan under the Gateway Process that being approximately $16,356 and adding to this the Loan of the working group to the Association for $7,004.00 bringing the amount required to $23,360.00

The members’ contribution of $100 per landowner accounted for about $3600 that being based on 36 members contributing. The expenses incurred since these funds were contributed are listed on the Web Page Financial Statement as a true record outlining all payments made for specifics listed.

Dave proceeded to explain the Gateway Process as this would enable the Association to determine whether it is a feasible way to have our properties submitted on a preliminary basis to the Council and the DOP for consideration for subdivision without having to outlay a lot of money. The sum of $23,356.00 when divided amongst a certain amount of members would not seem a lot to get the benefit of at least knowing if it is feasible to proceed or detract.

An example as to the amount required was on the overhead according to how many members would be prepared to contribute.

The benefits of having our properties included for possible subdivision was a major consideration to keep in mind. In doing nothing and remaining in the status quo we would not see any change occur to our properties for many years to come. Having the South Dural Association close to obtaining some determination from the DOP and the feed back we were given by the Mayor, Michael Edgar, Justin Taunton, Robyn Preston and Greg Burnett that it is important to work together with South Dural because if they get approval the 2156 Landowners Association would be in a great position to obtain the same favourable outcome.

Councillor Taunton was invited to address the meeting. Councillor Taunting reiterated what Dave was saying. Now is the appropriate time to push forward and keep in contact with the South Dural Association. He said that all the elements were favourable in terms of the Political change that came about with the DOP encouraging the Gateway Process. The South Dural Association will also need to work with our Association as it may be the case that the Sewer to service their development will need to connect to the Rouse Hill Plant. That being the case it means that it will come down from Old Northern Road into Glenhaven Road to connect to Rouse Hill Treatment Plant. One of the attendees address Councillor Taunting asking the question relating to the conditions of our Roads that nothing has changed over the last 25 years and when can we hope to see some improvements to the area. Councillor Taunton said that the Councill don’t have the necessary funds to make any improvements . Any improvements will need to be addressed by the Section 94 contribution which can only be raised if development come about from both the South Dural and the 2156 Landowners Association if these two don’t go ahead we can expect to remain just as things are at the present time. Another attendee asked as to how long it may take for us to obtain some positive outcome Councillor Taunton said that he could not give a positive indication but it would be possible to have an outcome within 2 years of engaging in the Gateway Process. Another positive note from Councillor Taunton was that he feels that apart from Councillor Barbara Barton who doesn’t want to see any changes take place, the rest of the Councillors at the Hills Shire Council would be in favour of our proposal. All those present felt encouraged by his comments and showed their appreciation for his coming to the meeting by clapping and thanking him.

Dave officially thanked Councillor Taunton who then excused himself to attend another meeting.

Dave once again returned to the financial circumstances that needed to be addressed. In order to make an informed decision as to whether we are in the position of going ahead it is necessary to have a commitment by all the landowners present to ascertain their willingness to financially contribute to accommodate the preliminary but very necessary submission to the Gateway Process. He asked for a show of hand to determine how many landowners were present. Upon counting these there were 24. Because of the low number present the contributions would need to be adjusted to compensate for the costing of the proposal. A figure of $800.00 per landowner was suggested by Dave and once again a show of hands suggested that those present would be in a position to absorb this cost.

One of the attendees, a lady who lives in Edgecliff Ave. Expressed that given that we invited all the landowners in the area and many did not attend the meeting it may be possible that the interest for subdivision is not in their mind and therefore we did not have the mandated from them to proceed with such a proposal... Dave agreed in principal.

A number of other attendees made their views known by saying that some landowners who were not present were very much interested by could not be present and wanted to be informed of the outcome of the meeting. With this in mind both Dave and Patrick decided to gage the commitment of those present by distributing an identification slip and commit to a contribution to be determined once the number of contributors can be assessed. Some of those present partook in completing the slips and handed them in while others took them home including extra copies to be handed out to their neighbours who could not be present. The slips are to be returned to Connie at N0.29 Glenhaven Road Glenhaven. When these are received we will be in the position to determine whether the Association has a mandate to go ahead or not.

Lastly the confirmation of the Association Honorary Position was to be determined with all position now vacant and a new nominations taken:

Dave Parson was nominated as President and seconded by Fred. Dave Excepted the nomination.

Patrick do Rozario was nominated as Treasurer by Lebba Khater and seconded by Mrs. Lam

Connie Fimmano was nominated as Secretary by Mrs. Parson and seconded by Patrick.

The status Quo remains until further notice.

Phone conversation with Robyn who apologises for not being able to attend last night but was glad that Justin attended. She was shocked about the email from Clr Burton and said that Clr Burton had a habit of saying things without full support. She confirmed that our group had support of herself, Greg Burnett, Mike Thomas, Justin Taunton and others and that we were recognised as a valid group by Council.

She also said that there will be alot of announcements shortly about South Dural, though could not give timing and that that would be the catalyst for our area. She is working part-time as an assistant to the new Liberal member for Granville. Apparantly, Justin Tauntin also assists a State Lib MP so he has insight to State Gvt matters too

Minutes of Bruce Lyon’s meeting circulated as follows:

Lebba and I met with Bruce Lyon at 4.30 pm and he had to leave at 5.45pm to attend a function at Curzon Hall Eastwood.

He gave us the attached sheet as his advice notes. Furthermore, he mentioned:

1. He expected that the sewerage to Glenhaven would go to Castle Hill Plant as primary treatment then to Rousse Hill treatment plant.

2. I mentioned that Ruth Frettingham from the DOP contacted us and Bruce said that he had met her and had discussions with her. I said that Dave mentioned that she contacted us regarding our submission for the Sydney Metro Strategy (probably our Association submission dated 23 April 2010 to the 5 year 2005 Sydney Metro Review entiltled Sydney Towards 2036) and that the DOP have been asked to review new opportunities for land release and we are invited to send a delegation for a meeting with the DOP.

3. I also mentioned that we had just received an email and letter from the Minister of Planning, Brad Hazzard, in relation to the potential for Glenhaven land being considered for new housing. The Minister asked the DOP to undertake an immediate review of the Association's submission and that the DOP will write to us shortly with further information about the review. Andrew Jackson, Executive Director, Strategy and Infrastructure Planning was the contact. Bruce said that he had met Andrew and that he was quite good.

4. Bruce emphasised that we needed to get more than the basic indications that were given by Brown Consulting about sewer and water servicing as the DOP would be concerned about guaranteeing these aspects for the development. We had to know the sewer catchment area. I said that Bob Welsh's idea for the North Glenhaven Precinct was that it would cover the natural creek and forest lines so as to add a seamless addition to the residential area, set apart from the rural areas. Therefore, the lowest points of the creeks would be consistent with the catchment areas.

5. Bruce said that, with South Dural, only members were to get the best rezoning. As a result, they got another 11 people as members who were formerly "sitting on the fence".

6. Bruce also commented about getting studies on Traffic upgrades (Glenhaven and Old Northern Rd), as well as Electricity and Telephone exchange capacity.

7. There was also a need to id the flora/fauna areas.

8. He enquiried about the prices of 5 acres lots. Lebba said that hilly lots were about $1.5-$1.6M and good land were about $1.8 - $2M.

9. As far as lot yields. He suggested about 12 dwellings per hectare, but in reality, this ended up about 10-11 (20% wasted for roads, sewer works etc).

10. Bruce suggested to go to Sydney Water and ask about the capacity.
As far as sewer enquiries, we had to get from Sydney Water the information in terms of "Equivalent Persons" where 1 person = 0.6 EPs. i.e. 5,000 people were 3,000 EQs.


Lebba and I spoke after the meeting and I proposed to contact Sydney Water to see the right contact person and then follow up sewer and water capacity enquiries. We will use the recent letter of Planning Minister Brad Hazzard as a way of confirming to Sydney Water of our bona fides and credability.

I will research the appropriate Sydney Water contact. I may phone the Sydney Water contacts mentioned in Stage 2 Precinct Plan for Box Hill etc as they might know the apporpraite Sydney water contact for our enquiries.

I have received from Grace your email regarding the servicing of land at North Glenhaven. I understand you are meeting with the Department of Planning and Infrastructure on 15 November to discuss the potential release of your land for urban purposes.

The detailed servicing needed for the Department will time and we are unable to prepare it in a week. I am meeting with representatives from the Department of Planning and Infrastructure at our regular meetings this Thursday. I will discuss the process of assessing applications for release of land and how the Department will seek comments from agencies, such as Sydney Water.

I will let you know what the Department suggests is the process that applicants and agencies need to follow so they are able to assess projects such as your proposal for North Glenhaven.

DOPI Meeting, Michael Brown also attending - Meeting Commenced: 10.15 am, 15th November 2010 (at 23-33 Bridge St Sydney NSW)

Michael Brown, Lebba and I attended the DOPI Meeting this morning with Helen Borrie (Senior Planner, DOPI MDP), Andrew Jackson (DOPI Executive, Strategy & Infrastructure / Land Release) and Peter Gould (NSW State Treasury). We gave them each a copy of the Association's Briefing Paper (copy attached).

As Michael briefed us before the Meeting, the priority of the DOPI in the present land review is on deliverability and dedication (commitment/funding). The DOPI had received numerous submissions in reply to the Minister of Planning's media call for lands to be delivered for urban housing. Our submission was one of those to be asssessed. The review will be a high-level one based on the deliverability and dedication aspects and, to address those matters it is the answers to the questions put forward by the DOPI (Sam Haddid) letter of 26 Oct 2011 that the DOPI will consider.

In the Meeting, we spoke about the issues of where our lands were, how close it was to services, shopping, infrastructure, parks and job centres etc. We spoke about how long the Association was around (since 2007) and that we had a good relationship with the Hills Council, the present Mayor Greg Burnett being one of our North Ward Counsellors) and our local MP Ray Williams

The present review was one conducted by the DOPI to identify lands that can be delivered for housing in the short-term and not a long-term matter. Key to this is how soon are groups able to deliver the lots for sale and whether they are willing to fund the necessary studies and infrastructure.

Lebba brought with him a large Map (cadastral Map) showing the land holding (DPs) and roads which were referred to by us all at the Meeting to idenitfy the potential of the area.

Andrew Jackson said the next step after the Association submitted any additional supporting information (by the 29 Nov 2011 due date) would be for them to identity lands that are suitable for urban release in the short-term and then forward a letter indicating timing, how quick the process and identify land use. When asked about how certain that identified land would be released for housing, he said could not give guarantees but the Minister had made public statements looking for new housing and that the present government policy is to get new housing quickly.

Letter from the DOP with their conclusion about the Association’s submission on potential for new housing (see copy of letter at Blog site).  The DOP concluded that our lands did not meet the criteria of housing to be provided in a short timeframe at no cost to government, primarily because of the fragmented ownership.  However, the government agreed to investigate the potential of land beyond the north-west boundary of Sydney under the Metropolitan Strategy include the Association’s site.

[1]   In the draft the minimum lot size has changed in Nelson and Maraylya, and the parts of Box Hill and Rouse Hill that are not included in the Box Hill Release Area from 40 hectares to 2 hectares. 

 

Also, clause 4.2B of draft LEP 2010 (Subdivision of Land in RU 2 Zone - Rural Landscape) allowed a 10 hectare (or greater) parcel zoned RU2 and affected by the Natural Resource - Biodiversity map could yield a maximum of 5 development lots and 1 neighbourhood lot. However, it is important to note that assessment of the individual site characteristics such as vegetation, slope, bush fire risk and access arrangements will influence the extent of actual development potential.

 

In addition to the above, appropriate management measures will be needed to ensure the landscape, biodiversity and rural setting of the land is protected and enhanced. Development controls will support rural cluster provisions and address aspects such as design, building platforms, vehicular access and effluent disposal.
